für die Nutzung des sog. Ticket-Shop auf der Homepage der
Carolinum zahnärztliches Universitäts-Institut gGmbH
GENERAL TERMS AND CONDITIONS
for the use of the so-called Ticket Shop on the website of the
Carolinum zahnärztliches Universitäts-Institut gGmbH
I. Geltungsbereich /
Scope of Application
Für sämtliche Verträge und erteilten Aufträge betreffend die Lieferung von Tickets über den sog. Ticket-Shop auf der Homepage https://www.event.goethe-dental-school.de der
Carolinum zahnärztliches Universitäts-Institut gGmbH (nachfolgend „Goethe Dental School“), über den die Goethe Dental School den Erwerb von Eintrittskarten (nachfolgend „Tickets“) für den Zugang zu Graduationsfeiern, Alumni-Tagen und ähnlichen Veranstaltungen anbietet, gelten im Verhältnis zur Goethe Dental School ausschließlich die nachfolgenden Allgemeinen Geschäftsbedingungen.
For all contracts and orders placed regarding the delivery of tickets via the so-called Ticket Shop on the website https://www.event.goethe-dental-school.de of the Carolinum zahnärztliches Universitäts-Institut gGmbH (hereinafter "Goethe Dental School"), through which the Goethe Dental School offers the purchase of admission tickets (hereinafter "Tickets") for admission to graduation ceremonies, alumni days, and similar events, the following General Terms and Conditions apply exclusively in relation to the Goethe Dental School.
II. Vertragsabschluss, Stornierung /
Conclusion of Contract, Cancellation
1. Das Angebot für einen Vertragsabschluss geht vom Kunden aus, sobald er im Ticket-Shop das Feld „Add to shopping cart“ für einen Kauf der entsprechenden Tickets angeklickt hat. Erst mit Eingabe der korrekten Zahlungsdaten und Übersendung der Bestellbestätigung (die zugleich die Funktion entsprechender Tickets erfüllt) durch die Goethe Dental School an den Kunden kommt ein Vertrag zwischen dem Kunden und der Goethe Dental School zustande. Die Möglichkeit des Kaufs von Tickets setzt voraus, dass der Kunde den vorliegenden Allgemeinen Geschäftsbedingungen, die im Ticket-Shop einsehbar und ausdruckbar sind, zuvor durch Anklicken des entsprechenden Zustimmungsfeldes zugestimmt hat; abweichende Bedingungen des Kunden haben keine Gültigkeit. Die Goethe Dental School bestätigt den Ticket-Kaufvertrag per E-Mail durch die Übersendung des Bestellbestätigung an die vom Kunden hinterlegte E-Mail-Adresse.
The customer submits an offer to conclude a contract as soon as they click the "Add to shopping cart" field in the Ticket Shop to purchase the corresponding tickets. A contract between the customer and Goethe Dental School is only concluded once the correct payment details have been entered and the order confirmation (which also serves as the corresponding ticket) has been sent to the customer by Goethe Dental School. The option to purchase tickets requires that the customer has previously agreed to these General Terms and Conditions, which are available for viewing and printing in the Ticket Shop, by clicking the corresponding consent field; any deviating terms and conditions of the customer are not valid. Goethe Dental School confirms the ticket purchase contract by e-mail by sending the order confirmation to the e-mail address provided by the customer.
2. Für die Richtigkeit der im Online-Auftritt der Goethe Dental School enthaltenen Daten wird keine Gewähr übernommen.
No liability is assumed for the accuracy of the data contained in the Goethe Dental School website.
3. Die Goethe Dental School ist berechtigt, eine Bestellung des Kunden, für die bereits eine Bestellbestätigung übersandt worden ist, zu stornieren (einseitiges Rücktrittsrecht), wenn der Kunde gegen von der Goethe Dental School ggf. aufgestellte spezifische Bedingungen für den Erwerb von Tickets verstößt, auf die im Rahmen des Verkaufs hingewiesen wurde, oder diese zu umgehen versucht (z.B. Verstoß gegen Beschränkungen der Ticketmenge pro Kunde). Die Erklärung der Stornierung/des Rücktritts kann auch konkludent durch Gutschrift der gezahlten Beträge erfolgen.
Goethe Dental School is entitled to cancel a customer's order for which an order confirmation has already been sent (unilateral right of withdrawal) if the customer violates any specific conditions for the purchase of tickets established by Goethe Dental School, which were indicated during the sale, or attempts to circumvent them (e.g., violation of ticket quantity restrictions per customer).The declaration of cancellation/withdrawal may also be made implicitly by crediting the amounts paid.
4. Auf das vorbenannte Rücktrittsrecht finden die §§ 346 ff. BGB unter Ausschluss von § 350 BGB Anwendung.
Sections 346 et seq. of the German Civil Code (BGB) apply to the aforementioned right of withdrawal, excluding Section 350 of the BGB.
5. Der Vertragstext wird nach dem Vertragsschluss nicht gespeichert und ist dem Kunden nicht zugänglich.

6. Der Kunde kann Eingabefehler betreffend Kontaktdaten und Zahlart-Auswahl vor Abgabe seiner Bestellung erkennen und jederzeit berichtigen. Bei der Auswahl der Tickets kann der Kunde Eingabefehler vor Abgabe seiner Bestellung erkennen und jederzeit mit Hilfe des Feldes „Ändern“ berichtigen.

7. Im Falle von Verlegungen von Veranstaltungen ist die Goethe Dental School berechtigt, die Gültigkeit der ursprünglichen Tickets der verlegten Veranstaltung für den neuen, verlegten Termin der Veranstaltung zu erklären. Eine Rückgabe der Tickets oder eine Rückabwicklung des Ticket-Kaufs infolge der Verlegung ist in diesen Fällen nicht möglich, es sei denn, die Wahrnehmung des verlegten Termins ist für den Ticketinhaber nachweislich nicht zumutbar. Dies gilt nicht, sofern die Goethe Dental School die Verlegung der Veranstaltung zu vertreten hat. Ungeachtet der vorstehenden Regelungen wird sich die Goethe Dental School stets bemühen, die Angelegenheit im Interesse des Kunden zu regeln.
In the event of event rescheduling, Goethe Dental School is entitled to declare the original tickets for the rescheduled event valid for the new, rescheduled date. In these cases, tickets cannot be returned or the ticket purchase reversed unless it can be proven that attending the rescheduled date is unreasonable for the ticket holder. This does not apply if Goethe Dental School is responsible for the rescheduling. Notwithstanding the above provisions, Goethe Dental School will always endeavor to resolve the matter in the customer's interest.
8. Im Hinblick auf die Art der Veranstaltungen, für die Tickets über den Ticket-Shop erworben werden können, behält sich die Goethe Dental School vor, Veranstaltungen abzusagen, falls nur eine unzureichende Anzahl von Tickets für die jeweilige Veranstaltung verkauft werden können. Eine Absage muss spätestens drei Wochen vor dem Datum der jeweiligen Veranstaltung dem Kunden per E-Mail mitgeteilt werden; maßgeblich für die Einhaltung der Frist ist das Datum der Versendung der Absage-E-Mail durch die Goethe Dental School. Im Falle einer ordnungsgemäßen Absage wird die Goethe Dental School dem Kunden den Preis der Tickets unverzüglich vollständig erstatten. Darüberhinausgehende Ansprüche des Kunden gegenüber der Goethe Dental School wegen einer Veranstaltungsabsage, insbesondere Ansprüche auf Ersatz vergeblicher Aufwendung, sind ausgeschlossen. Ungeachtet der vorstehenden Regelungen wird sich die Goethe Dental School stets bemühen, die Angelegenheit im Interesse des Kunden zu regeln.
Due to the nature of the events for which tickets can be purchased through the ticket shop, Goethe Dental School reserves the right to cancel events if an insufficient number of tickets can be sold for the respective event. Cancellations must be communicated to the customer by e-mail at least three weeks before the date of the respective event; the date of the cancellation e-mail sent by Goethe Dental School is decisive for compliance with this deadline. In the event of a proper cancellation, Goethe Dental School will promptly refund the customer the full price of the tickets. Any further claims by the customer against Goethe Dental School due to an event cancellation, in particular claims for reimbursement of wasted expenses, are excluded. Notwithstanding the above provisions, Goethe Dental School will always endeavor to resolve the matter in the customer's interest.
9. Die Abwicklung der Bestellung und Übermittlung aller im Zusammenhang mit dem Vertragsschluss erforderlichen Informationen erfolgt per E-Mail (zum Teil automatisiert). Der Kunde hat daher sicherzustellen, dass die von ihm hinterlegte E-Mail-Adresse zutreffend ist, der Empfang von E-Mails technisch sichergestellt und insbesondere nicht durch SPAM-Filter verhindert wird.
The order is processed and all information required for the conclusion of the contract is transmitted via e-mail (partially automated). The customer must therefore ensure that the e-mail address provided is correct, that the receipt of e-mails is technically secured, and, in particular, that it is not blocked by spam filters.
III. Preisbestandteile und Zahlungsmodalitäten /
Price Components and Payment Methods
1. Die Preise für Tickets können ggf. Entgelte für die Nutzung bestimmter Zahlungsmittel enthalten. Die Zahlung ist je nach Veranstaltung und Bestellmodalitäten per Kreditkarte möglich. Die gesetzliche Umsatzsteuer, soweit anfallend, sowie etwaige Versandkosten sind im Preis enthalten. Der Gesamtpreis der Bestellung inklusive aller Gebühren ist nach Vertragsabschluss sofort zur Zahlung fällig.
Ticket prices may include fees for the use of certain payment methods. Depending on the event and the ordering method, payment is possible by credit card. Statutory sales tax, if applicable, as well as any shipping costs are included in the price. The total price of the order, including all fees, is due immediately upon conclusion of the contract.
2. Bei der Internet-Bestellung werden keine Servicekosten erhoben, soweit nicht im Rahmen des Bestellvorgangs unter „Surcharge for payment“ anderweitig ausgewiesen.
No service fees are charged for online orders unless otherwise stated during the ordering process under "Surcharge for payment."
IV. Liefer- und Einlösebedingungen /
Delivery and Redemption Conditions
1. Die erworbenen Tickets werden in Form der Bestellbestätigung, die zugleich die Funktion entsprechender Tickets erfüllt, zur Verfügung gestellt.
Purchased tickets will be made available in the form of an order confirmation, which also serves as a ticket.
2. Gekaufte Tickets berechtigen zur Inanspruchnahme der mit dem jeweiligen Ticket zugesagten Leistungen. Es gilt dabei die Leistungsbeschreibung zum Zeitpunkt des Kaufs des Tickets einschließlich der dort aufgeführten Ausschlusskriterien, Termine, Orte sowie sonstigen Anforderungen an den jeweiligen Teilnehmer. Die Einlösung der Tickets am Veranstaltungstag ist nur einmal durch eine Person möglich. Ticktes sind nicht personifiziert und auch auf eine andere Person übertragbar; dies gilt allerdings nicht, wenn und soweit der Zugang zu der Veranstaltung auf einen definierten Personenkreis beschränkt ist und diese andere Person diesem definierten Personenkreis nicht angehört.
Purchased tickets entitle the holder to use the services promised with the respective ticket.The service description at the time of purchase applies, including the exclusion criteria, dates, locations, and other requirements for the respective participant listed therein.Tickets may only be redeemed once by one person on the day of the event.Tickets are not personalized and are transferable to another person;however, this does not apply if and to the extent that access to the event is restricted to a defined group of persons and this other person does not belong to this defined group of persons.
V. Kein Widerrufsrecht /
No Right of Withdrawal
Ein Widerrufsrecht für Verbraucher besteht nicht bei Verträgen zur Erbringung von Dienstleistungen in den Bereichen Beherbergung zu anderen Zwecken als zu Wohnzwecken, Beförderung von Waren, Kraftfahrzeugvermietung, Lieferung von Speisen und Getränken sowie zur Erbringung weiterer Dienstleistungen im Zusammenhang mit Freizeitbetätigungen, wenn der Vertrag für die Erbringung einen spezifischen Termin oder Zeitraum vorsieht (§ 312g Abs. 2 Satz 1 Nr. 9 BGB). Das heißt, soweit die Goethe Dental School Dienstleistungen aus dem Bereich der Freizeitbetätigung anbietet, insbesondere Eintrittskarten für Veranstaltungen, besteht kein Widerrufsrecht. Jede Bestellung von Tickets ist damit unmittelbar nach Bestätigung durch die Goethe Dental School gemäß Ziffer II. 1. dieser Allgemeinen Geschäftsbedingungen bindend und verpflichtet zur Abnahme und Bezahlung der bestellten Karten.
Consumers do not have a right of withdrawal for contracts for the provision of services in the areas of accommodation for purposes other than residential use, the transport of goods, motor vehicle rental, the delivery of food and beverages, or the provision of other services related to leisure activities if the contract stipulates a specific date or period for the provision (Section 312g Paragraph 2 Sentence 1 No. 9 of the German Civil Code (BGB)). This means that, to the extent that Goethe Dental School offers services in the area of leisure activities, in particular tickets for events, there is no right of withdrawal. Each ticket order is therefore binding immediately upon confirmation by Goethe Dental School in accordance with Section II.1. of these General Terms and Conditions and obligates the purchaser to accept and pay for the ordered tickets.
VI. Haftungsbeschränkungen, Ausschluss des Rücktritts bei bestimmten Pflichtverletzungen /
Limitations of Liability, Exclusion of Withdrawal in Cases of Certain Breach of Duty
1. Die Goethe Dental School haftet in jedem Fall unbeschränkt nach dem Produkthaftungsgesetz, für vorsätzlich oder grob fahrlässig verursachte Schäden, bei arglistigem Verschweigen von Mängeln, sowie für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Auch die Haftung für Schäden aus der Verletzung einer Garantie ist unbeschränkt.
Goethe Dental School is liable without limitation under the Product Liability Act for damages caused intentionally or through gross negligence, for fraudulent concealment of defects, and for damages resulting from injury to life, body, or health. Liability for damages resulting from a breach of a warranty is also unlimited.
2. Bei Verletzung wesentlicher Vertragspflichten (sog. Kardinalpflichten), die nur auf einfacher Fahrlässigkeit beruht, haftet die Goethe Dental School beschränkt auf den Ersatz des bei Vertragsabschluss vorhersehbaren, vertragstypischen unmittelbaren Schadens.
In the event of a breach of essential contractual obligations (so-called cardinal obligations („Kardinalpflichten“)) based solely on simple negligence, Goethe Dental School's liability is limited to compensation for direct damages typical of the contract that were foreseeable at the time the contract was concluded.
3. Außer in den in Absätzen 1 und 2 genannten Fällen haftet die Goethe Dental School nicht für Schäden, die durch einfache Fahrlässigkeit verursacht wurden.
Except in the cases specified in paragraphs 1 and 2, Goethe Dental School is not liable for damages caused by simple negligence.
4. Das Recht des Kunden, sich wegen einer nicht von der Goethe Dental School zu vertretenden, nicht in einem Mangel der Ware bestehenden Pflichtverletzung vom Vertrag zu lösen, ist ausgeschlossen.
The customer's right to withdraw from the contract due to a breach of duty for which Goethe Dental School is not responsible and which does not constitute a defect in the goods is excluded.
5. Soweit die Haftung der Goethe Dental School nach den vorstehenden Absätzen ausgeschlossen oder beschränkt ist, gilt dies auch für die Haftung ihrer Erfüllungs- und Verrichtungsgehilfen.
To the extent that Goethe Dental School's liability is excluded or limited under the preceding paragraphs, this also applies to the liability of its vicarious agents and employees.
6. Die Goethe Dental School übernimmt keine Gewähr dafür, dass der Betrieb der Website bzw. des Ticket-Shops ungestört ist von Unterbrechungen oder Fehlern. Sie wird sich bemühen, soweit dies technisch möglich ist, den Betrieb der Website bzw. des Ticket-Shops frei von Fehlern und Unterbrechungen zu halten. Die Goethe Dental School übernimmt ebenfalls keine Gewähr dafür, dass die Website frei von Viren oder anderen Störungserregern ist. Eine Haftung ist damit ebenfalls ausgeschlossen.
Goethe Dental School does not guarantee that the operation of the website or the Ticket Shop will be uninterrupted or error-free. Goethe Dental School will endeavor, to the extent technically feasible, to keep the operation of the website and the Ticket Shop free from errors and interruptions. Goethe Dental School also assumes no liability for the website being free of viruses or other sources of interference. Liability is therefore also excluded.
VII. Schlussklauseln /
Final Clauses
1. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland. Die Bestimmungen des UN-Kaufrechts finden ausdrücklich keine Anwendung. Unabhängig von der vorstehenden Regelung zur Rechtswahl können sich Verbraucher mit gewöhnlichem Aufenthalt außerhalb der Bundesrepublik Deutschland stets auch auf das Recht des Staates berufen, in dem sie ihren Wohnsitz haben.
The law of the Federal Republic of Germany shall apply exclusively. The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply. Notwithstanding the above provision regarding the choice of law, consumers with their habitual residence outside the Federal Republic of Germany may always also invoke the law of the country in which they are domiciled.
2. Alleiniger Erfüllungsort für Lieferung, Leistung und Zahlung ist Frankfurt am Main, sofern der Kunde Unternehmer i.S.v. § 14 BGB ist.
The sole place of performance for delivery, service, and payment is Frankfurt am Main, provided the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB).
3. Ist der Kunde Kaufmann, so ist ausschließlicher (auch internationaler) Gerichtsstand für alle sich aus dem Vertragsverhältnis unmittelbar oder mittelbar ergebenen Streitigkeiten Frankfurt am Main. Dies gilt im Falle von grenzüberschreitenden Verträgen auch für Nichtkaufleute. Die Goethe Dental School behält sich das Recht vor, auch jedes andere international zuständige Gericht anzurufen.
If the customer is a merchant, the exclusive (including international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Frankfurt am Main. In the case of cross-border contracts, this also applies to non-merchants. Goethe Dental School reserves the right to also resort to any other internationally competent court.
4. Die Goethe Dental School ist nicht bereit oder verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Goethe Dental School is not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
5. Die Goethe Dental School behält sich vor, diese Allgemeinen Geschäftsbedingungen jederzeit zu ändern, wobei solche Änderungen in Kraft treten, sobald sie auf der Website der Goethe Dental School veröffentlich worden sind. Die Goethe Dental School behält sich auch das Recht vor, nach freiem Ermessen und ohne Vorankündigung den Ticket-Shop ganz oder teilweise einzustellen oder zu verändern.
Goethe Dental School reserves the right to change these Terms and Conditions at any time, with such changes taking effect upon publication on the Goethe Dental School website. Goethe Dental School also reserves the right, at its sole discretion and without prior notice, to discontinue or modify the Ticket Shop in whole or in part.
6. Die Übersetzung dieser Allgemeinen Geschäftsbedingungen in die englische Sprache ist rechtlich unverbindlich und dient lediglich Informationszwecken. Im Falle einer etwaigen Unstimmigkeit zwischen dem deutschen Text und dem englischen Text geht der deutsche Text als allein rechtsverbindlicher Text vor.
The English translation of these General Terms and Conditions is not legally binding and is for informational purposes only. In the event of any discrepancy between the German and English texts, the German text shall prevail as the sole legally binding text.
